Refund Policy

This document is an unreviewed first draft prepared for evaluation by a licensed attorney. It is not legal advice and it is not in effect. OptimizePlus does not currently have an adopted refund policy; everything below is a proposal for one, and each proposed term also requires operational and engineering work before it can be honored. Items marked [REVIEW] are open decisions.

1What this covers, and the principle behind it

This policy applies to everything you can buy from OptimizePlus: credit packs, managed packages (setup fee and monthly fee), and website development projects. It forms part of our Terms of Service.

The principle is simple: you should be able to get your money back for work we have not done yet, and we should be accountable for work we did badly. What we cannot do is refund third-party compute we have already paid for on your behalf. Generating an image, a video, or an audit costs us real money at the moment it runs, whether or not you like the result. So unused value is refundable, consumed value is not, and quality problems are fixed by redoing the work.

2Credits

Unused credits

You may request a refund of your unused credit balance within [REVIEW: refund window — recommended 14 days from the date of the credit purchase] of the purchase. We refund the amount you actually paid for those credits, at the effective rate of the pack you bought (including any package discount you received), back to the original payment method. The refunded credits are removed from your balance at the same time.

Because credits from different packs may have been bought at different rates, refunds are applied against your most recent purchases first. [REVIEW: confirm this ordering rule, and confirm the accounting treatment of a partially consumed pack]

Consumed credits

Credits already spent on a completed generation are not refundable. Once a job runs, the third-party model has been called and the cost is incurred. If you are unhappy with what came back, the remedy is section 5, not a refund.

Credits do not expire

We do not put a clock on credits, so there is no need to refund them to avoid losing them. If you are not ready to use your balance, it will still be there.

Failed generations

If a job fails for a technical reason on our side or on a provider's side and produces no usable output, the credits for that job are returned to your balance. Tell us if you see a failed job that was not credited back. 3Managed packages

Setup fee

The one-time setup fee covers onboarding, account and brand configuration, initial audits, and strategy work. It is refundable in full if you cancel before we begin that work, and [REVIEW: whether the setup fee becomes fully non-refundable at kickoff, or is refundable pro-rata for a short period; recommended: fully non-refundable once onboarding work begins, with a 7-day unconditional refund window before kickoff].

Monthly fee

Monthly fees are billed in advance for a month of work. You may cancel at any time by emailing legal@optimizeplus.agency; cancellation takes effect at the end of the current billing month, and you keep the deliverables for the month you paid for. We do not pro-rate a partial month, because the month's production work is generally front-loaded.

If we have not delivered any of the month's committed work at the time you cancel, ask us — we will refund that month. [REVIEW: whether this discretionary carve-out should be a firm commitment tied to a defined deliverable list, which is the only way it becomes enforceable in either direction]

A package never includes credits

Package fees and credit purchases are separate transactions. Cancelling a package does not refund credits, and refunding credits does not cancel a package. A package that has been cancelled also ends the credit-purchase discount going forward; it does not claw back a discount already given.

4Website development projects

Website builds are fixed-price professional services delivered by people, not metered generation, so they follow milestones rather than credits:

  • Cancel before work starts: full refund.
  • Cancel after work starts but before first delivery: we refund the project fee less the work performed, with a non-refundable deposit of [REVIEW: deposit percentage — recommended 50% of the tier price].
  • After first delivery: the project fee is non-refundable. Revisions are handled under the scope agreed for your tier.
  • Add-ons (extra pages, copywriting, logo design, SEO setup, rush delivery) follow the same rule as the tier they were purchased with, and rush fees are non-refundable once the rush schedule has been started.

5The quality remedy: one free regeneration

If a deliverable does not match the brief you approved, tell us within [REVIEW: claim window — recommended 7 days of delivery] and we will regenerate it once at no credit cost to you. This is our primary remedy for quality problems, and it applies to generated copy, images, video, audio, and audit reports.

To use it, send us the job or deliverable reference and say specifically what does not match the brief.

What the free regeneration is, and is not:

  • It covers output that fails to reflect the brief, the wrong subject, obviously broken or unusable output, and material factual errors about your own business that we introduced.
  • It does not cover a change of mind, a new brief, or a different creative direction. That is new work, and it costs credits.
  • It is one regeneration per deliverable. Further attempts are charged normally. [REVIEW: whether one regeneration is the right number, and whether repeated quality failures should escalate to a refund of the credits spent]

6What we do not refund

  • Credits already consumed by a completed generation.
  • Deliverables you have already published, distributed, or used commercially.
  • Marketing outcomes. We do not guarantee rankings, traffic, leads, conversions, or revenue, and a disappointing outcome is not a defect. See the disclaimers in our Terms.
  • Advertising. Where you fund your own advertising account, that money goes from you to the platform and never passes through us — there is nothing for us to refund, and a billing dispute is with the platform. Where advertising is included in an all-inclusive package fee, that fee buys the service for the month rather than a set amount of media, so it is not refundable on the basis of how much was spent on ads in a given month. Package fees are otherwise covered by the rest of this policy, and you can cancel at any time to stop the next payment.
  • Third-party costs you incur directly, such as domain registration, hosting, or a subscription you bought from another vendor.
  • Charges more than [REVIEW: outer time limit — recommended 90 days] old, except where the law requires otherwise.

7Chargebacks: talk to us first

If something is wrong with a charge, email us before you dispute it with your bank. Nearly everything is resolvable directly and far faster than a dispute.

  • Filing a chargeback without first contacting us is a breach of our Terms. We may suspend or close the account while a dispute is open.
  • We will respond to disputes with our records, including the purchase record, the credits delivered, and the jobs run against them.
  • If a chargeback succeeds on a purchase whose credits were already spent, we reserve the right to recover the amount and any dispute fee, and to require prepayment for future work.
  • Any credits paid for by a reversed charge are removed from your balance.

8How to request a refund

Email legal@optimizeplus.agency from the address on your account with:

  • your account email and business name;
  • the invoice number, receipt, or charge date;
  • what you are asking for and why.

We aim to acknowledge within [REVIEW: response target — recommended 3 business days] and to decide within [REVIEW: decision target — recommended 10 business days]. Approved refunds go back to the original payment method through Stripe; how quickly the money appears is up to your bank, typically 5 to 10 business days.

We may ask for information to verify the account and the purchase before issuing a refund.

9Your statutory rights

Nothing in this policy limits any right you have under applicable law that cannot be waived, including under California consumer protection law. Where the law gives you a better remedy than this policy does, the law wins.
